Kava Terms of Use

Kava (“Kava,” “we,” “us,” or “our”) is operated by Farspire Enterprises Inc. These terms apply to the Kava mobile application and to this website.

The Licence

Kava is distributed through Apple's App Store, and your use of it is governed by Apple's Licensed Application End User Licence Agreement, which applies to apps that do not supply their own. Kava does not supply its own, so that agreement is the licence, and these terms sit alongside it to describe what Kava actually does.

What Kava Is

Kava is a personal record of the cafés you have been to. You mark cafés, rate them, write notes and add photos, and the app draws a map of where you have been. The café list comes from Overture Maps data served by Kava's own backend. It is offered as it is: café details can be wrong, out of date or missing, and you should not rely on Kava to tell you whether a café exists or is open.

Your Content

Your visits, ratings, notes and photos are yours. Kava claims no ownership of them and shows them to nobody: there is no feed, no followers and no way for another person to browse your map.

Where they are stored, and the one case in which a copy reaches our servers, is set out in the privacy policy.

Accounts

An account is optional. Kava works fully without one, and creating one adds backup and the ability to sign in on another phone. You are responsible for keeping your sign-in details to yourself, and you can delete your account from inside the app at any time.

kava+ Subscriptions

kava+ is an optional subscription that adds two things: your cafés backed up and restored to a new phone, and a map without the big chains. Everything that is free today stays free.

• It is sold monthly or yearly. The price is shown in the app before you buy, in your own currency, and is charged to your Apple Account.
• A subscription renews automatically until you cancel it. Apple charges the renewal within 24 hours of the end of the current period.
• You can cancel any time in Settings, Apple Account, Subscriptions. Cancelling stops the next renewal; it does not refund the period you are in, and the paid features stay on until that period ends.
• Where a free trial is offered, Apple grants it once per subscription group per customer, so somebody who has used it already will be offered the subscription without one. If you cancel before the trial ends you are not charged.
• Payment is taken by Apple, not by us. We never see your card details. Refunds are handled by Apple, through reportaproblem.apple.com.

If a subscription ends, the paid features stop and nothing you created is deleted from your phone. What happens to the copy on our servers is described in the privacy policy.

Fair Use

Please do not attempt to break, overload or reverse engineer Kava or its backend, use it unlawfully, or scrape the café catalog. The catalog is built from Overture Maps data under the CDLA-Permissive-2.0 licence, which has its own attribution requirements.

Availability

Kava is a small product under active development. Features may change and the service may be interrupted. We will not remove a feature you have already paid for during the period you have paid for.

Liability

To the extent permitted by law, Kava is provided without warranties, and Farspire Enterprises Inc. is not liable for indirect or consequential loss arising from your use of it. Nothing in these terms limits rights you have under consumer law where you live.

Changes to These Terms

We may update these terms as Kava changes. When we do, we will update this page and revise the effective date above.
