Kava (“Kava,” “we,” “us,” or “our”) is operated by Farspire Enterprises Inc. These terms apply to the Kava mobile application and to this website. By using either, you agree to them. If you do not agree, please do not use Kava.
The Licence
Kava is distributed through Apple's App Store, and your licence to use it is governed by Apple's Licensed Application End User Licence Agreement, which applies to apps that do not supply their own. Kava does not supply its own, so that agreement is the licence. These terms sit alongside it and describe the service Kava provides. Where the two conflict on the licence itself, Apple's agreement governs.
What Kava Is
Kava is a personal record of the cafés you have been to. You mark cafés, rate them, write notes and add photos, and the app draws a map of where you have been. It has no feed and no followers, and nobody else can browse your map.
The Café Catalog
The café list comes from Overture Maps data, served by Kava's own backend and used under the Community Data License Agreement – Permissive, Version 2.0. City boundaries are © OpenStreetMap contributors, looked up through Nominatim and available under the Open Database License. The app credits both wherever their data appears.
The catalog is offered as it is. Café names, locations, categories, logos and chain labels can be wrong, out of date or missing, and a café may have moved or closed. Do not rely on Kava to tell you whether a café exists, is open, is accessible, or is safe for you, and check anything that matters, such as allergens, with the café itself. Kava's ratings are yours alone; Kava does not rate cafés.
Who Can Use Kava
Kava is for a general audience. If you are under 13, or under 14 in Quebec, you need a parent's or guardian's permission to create an account or send feedback. If you are under the age of majority where you live, a parent or guardian should agree to these terms for you before you create an account.
Accounts
An account is optional, and all of Kava works without one. Only backup of your cafés needs an account. You can create one with an email address and password, or with Sign in with Apple. Please give us an email address that is yours, keep your password to yourself, and tell us if you think someone else is using your account. You are responsible for what happens under your account.
You can delete your account at any time in the app: open the Profile tab and tap Delete my account. Deletion is permanent and removes your backup; what it removes and what outlasts it is set out in the privacy policy.
We may suspend or close an account that is used to break these terms or the law, or to harm Kava or other people. Where it is reasonable to do so, we will tell you why first.
Free to Use
Features may be added, changed or removed. The cafés on your phone are the only copy unless you turn on backup, so please back up what you cannot afford to lose.
Kava is free. Kava sells nothing, there is no charge, we ask for no payment details, and there is nothing to cancel. Hide big chains needs no account. Backup needs a free account.
Later we plan kava+, a paid add-on. Before we sell anything, we will update these terms and tell account holders in the app or by email. If free backup ends, your backup stops taking changes and is deleted 90 days after its last change, as the privacy policy describes. Nothing on your phone is deleted, and Hide big chains stays free.
Your Content
Your visits, ratings, notes and photos are yours. Kava claims no ownership of them and shows them to nobody. Notes and ratings stay on your phone unless you turn on backup, and photos never leave it.
If you turn on backup, you allow us to store and copy that content for the one purpose of keeping it and bringing it back to you. That permission ends when you turn backup off or delete your account.
Feedback
When you send us feedback, ideas or suggestions, from the app, by email or on Discord, you allow us to use, change and build on them freely, worldwide, without paying you or owing you credit, and that permission does not end. It gives us no rights over your personal information, which we treat as the privacy policy describes. Please do not send us anything confidential, or anything about another person that they would not want shared.
Fair Use
Please do not:
- attempt to break, overload, probe or reverse engineer Kava or its backend, or get around its limits;
- scrape or bulk-download the café catalog, or use it to build a competing dataset through Kava rather than from its open sources;
- use Kava, including feedback, to send spam, malware, or unlawful, abusive or infringing material;
- pretend to be someone else, or use someone else's account;
- use Kava in any way that breaks the law.
The underlying Overture Maps and OpenStreetMap data is open, and you are free to get it from its own sources under its own licences.
The Discord Server
Kava runs a Discord server for people waiting on the launch. It is optional, it is not part of the app, and while you are there Discord's own terms apply to you as well as these. Keep it civil: no harassment, no spam or advertising, and nothing unlawful. We can remove a post or a member from the server at our discretion, and doing so affects nothing about your Kava account.
Other Services
Kava relies on services we do not control, including the App Store, Sign in with Apple, and the open data sources above. Their terms apply to your use of them, and we are not responsible for their availability or content.
Availability
Kava is a small product under active development. Features may change and the service may be interrupted, including for maintenance. If we ever shut Kava's servers down, we will give account holders reasonable notice first.
Liability
To the extent permitted by law, Kava is provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties that it will be uninterrupted, error-free, or that the catalog is accurate. Farspire Enterprises Inc. is not liable for indirect, incidental, special or consequential loss, or for loss of data, arising from your use of Kava. To the extent permitted by law, our total liability to you for any claim about Kava is limited to CAD $50.
Nothing in these terms limits or excludes rights you have under consumer protection law where you live that cannot be limited or excluded, or our liability for anything that cannot legally be limited, such as liability for our own fraud, gross negligence or intentional fault. If you live in Quebec, the limits in this section apply only as far as the Quebec Consumer Protection Act allows.
Governing Law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. Disputes may be brought in the courts of Ontario. If you are a consumer, you also keep the protection of the mandatory laws of the place you live and the right to bring a claim in the courts there.
Changes to These Terms
We may update these terms as Kava changes, and when we do we will update this page and revise the date above. If a change is significant, we will tell account holders in the app or by email before it takes effect. Continuing to use Kava after a change takes effect means you accept it; if you do not, you can stop using Kava and delete your account.
